Terms of Use
The one that matters. Above You is for curiosity and education. It is not an air traffic control tool, not a navigation aid, and not a source you may rely on for any operational or safety decision.
These terms apply to the Above You mobile app and to above-you.app. By using either, you agree to them. If you do not, please do not use the app.
1. What you may do
You are granted a personal, non-exclusive, non-transferable licence to install and use Above You on devices you own or control, for your own non-commercial use. The app is provided free of charge.
2. What you may not do
- Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it.
- Scrape, bulk-download or resell the data the app displays, or use the API behind it as a data source for another product.
- Use automated means to place unreasonable load on the service, or attempt to circumvent its rate limits.
- Use the app for anything unlawful, or in any way that interferes with other people's use of it.
- Remove or obscure the photographer credit shown with an aircraft photograph.
3. Accuracy, and the limits of it
Flight positions come from open networks of volunteer ADS-B receivers. That means coverage is uneven, aircraft that do not broadcast do not appear, positions can be delayed or missing, and route and aircraft-type information is drawn from community databases that may be incomplete or wrong.
The information is provided for interest only. It must not be used for flight planning, navigation, aircraft separation, emergency response, or any decision where an error could cause harm or loss. Where a value cannot be established the app omits it rather than guessing, but no accuracy or availability is warranted.
4. Third-party content
Aircraft photographs are the property of the photographers who took them and are shown under the terms of the archives that publish them, always with attribution and a link to the original. Airline names, logos and aircraft type designations are the trademarks of their respective owners; their appearance in the app is nominative use and implies no affiliation or endorsement.
5. Availability
The service may be interrupted, changed or discontinued at any time, including because an upstream data source becomes unavailable. No uptime is promised. Features may be added or removed as the app develops.
6. Disclaimer of warranties
The app and website are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
7. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, profit or opportunity, arising from your use of or inability to use the app. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
8. Changes
These terms may be updated. The date at the top of this page changes when they are, and the current version always lives here. Continuing to use the app after a change means you accept the revised terms.
9. Governing law
These terms are governed by the laws of the Republic of Türkiye. If you are a consumer, this does not deprive you of the protection of mandatory consumer-law provisions of the country where you live.
